End User License Agreement

1. Agreement to Terms
This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and Appfluence Inc. ("Company," "we," "us," or "our") for the use of AngerAlert software and services ("Service"). By using AngerAlert, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
2. Grant of License
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the AngerAlert web application
- Connect your Microsoft Outlook email account for sentiment analysis
- Receive email analysis reports and notifications
- Use integration features with Slack and Microsoft Teams (where available)
3. Restrictions
You may not:
- Copy, modify, distribute, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for any unlawful purpose or activity
- Attempt to gain unauthorized access to the Service or its systems
- Use the Service to spam, harass, or violate others' privacy
- Share your account credentials with third parties
- Exceed rate limits or attempt to overload our systems
- Remove or alter any proprietary notices or labels
4. User Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your use complies with applicable laws and regulations
- Backing up any important data before account deletion
- Providing accurate and current contact information
- Complying with Microsoft's terms of service for Graph API usage
5. Service Availability
AngerAlert is provided on an "as is" and "as available" basis. We do not guarantee:
- Uninterrupted or error-free service operation
- 100% accuracy of sentiment analysis results
- Availability of all features at all times
- Compatibility with all email configurations
- Immediate processing of all emails
6. Data Usage and Privacy
By using AngerAlert, you acknowledge and agree that:
- We will access your email data solely for sentiment analysis purposes
- Email content is processed using automated sentiment analysis algorithms
- We may store analysis results and metadata for service improvement
- Our Privacy Policy governs all data collection and usage practices
- You have the right to delete your data at any time
7. Intellectual Property
AngerAlert and all related intellectual property rights are owned by Appfluence Inc. This includes:
- Software code, algorithms, and architecture
- Trademarks, logos, and branding materials
- User interface designs and layouts
- Documentation and help materials
- Analysis methodologies and scoring systems
8. Termination
This Agreement remains in effect until terminated by either party:
- By You: Disconnect your account or stop using the Service
- By Us: Immediately if you violate this Agreement
- Effect of Termination: Your license ends, and we may delete your data
- Survival: Sections 7, 9, 10, and 11 survive termination
9. Subscription Terms and Billing
AngerAlert offers subscription plans with usage-based features:
- Plan Types: Free and paid subscription tiers with different feature sets and usage limits
- Usage Limits: Service may be restricted upon reaching plan-specific limits
- Trial Period: Free trial available for paid features
- Billing: Automatic renewal unless canceled before the next billing cycle
- Cancellation: Cancel anytime via dashboard; service continues until current period end
- Plan Changes: Upgrades take effect immediately; downgrades at next billing cycle
Refund Policy
- Trial Period: No charges during free trial period
- Monthly Plans: No refunds for monthly subscriptions
- Annual Plans: Prorated refund available within 30 days of payment
- Billing Errors: Immediate correction of incorrect charges
- Gift Subscriptions: Non-refundable once activated
10. Disclaimers
ANGERALERT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy or completeness of sentiment analysis
- Compatibility with your specific email environment
- Security against all possible threats
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability shall not exceed the amount you paid for the Service in the last 12 months
- We are not liable for indirect, incidental, special, or consequential damages
- We are not liable for business interruption, lost profits, or data loss
- We are not liable for third-party actions or system failures
- Some jurisdictions may not allow these limitations
12. Indemnification
You agree to indemnify and hold harmless Appfluence Inc. from any claims, damages, or expenses arising from:
- Your use of AngerAlert in violation of this Agreement
- Your violation of any third-party rights
- Your violation of applicable laws or regulations
- Any content you provide through the Service
13. Governing Law
This Agreement is governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of California.
14. Changes to This Agreement
We may modify this Agreement at any time by:
- Posting the updated Agreement on our website
- Updating the "Last updated" date
- Notifying you via email for material changes
- Your continued use constitutes acceptance of changes
15. Third-Party Services
AngerAlert integrates with third-party services subject to their own terms:
- Microsoft Graph API: Subject to Microsoft's Service Agreement
- Slack API: Subject to Slack's Terms of Service
- AWS Services: Subject to AWS Customer Agreement
- You are responsible for compliance with all applicable third-party terms
